A photo-radar offence carries a fine, but no demerit points. Here is how it works and how to contest.
In briefIn Quebec, a photo-radar offence carries a fine and fees, but no demerit points: the device identifies the vehicle, not the driver. The offence is charged to the registered owner, who has 30 days to contest.
Quebec uses fixed photo radars (roadside), mobile photo radars (deployed notably in school and construction zones) and red-light cameras, some of which also monitor speed.
Because the radar identifies the vehicle but not the driver, no demerit points are recorded and there is no points-related insurance increase. The ticket includes the fine, fees and a mandatory contribution.
The Highway Safety Code presumes the registered owner liable. Since July 1, 2024, the owner can no longer designate another driver: they remain liable regardless of who was driving.
You have 30 days to plead not guilty. You can request disclosure of the evidence (photos, device certification) and check service deadlines: the ticket must be served within the prescribed time, failing which it can be challenged.
