Overview of the Law

Under section 406.1 of the Quebec Highway Safety Code, drivers must reduce speed and, when safe, move to another lane when approaching a stopped emergency vehicle, tow truck, or roadside assistance vehicle with flashing or rotating lights.

  • 100 km/h on autoroutes
  • 90 km/h on concrete or asphalt highways
  • 70 km/h on gravel roads
  • 50 km/h in built-up areas

This rule exists to protect first responders, tow operators, and roadside workers from being struck by passing vehicles. Even if no accident occurs, failing to slow down or switch lanes safely is a punishable offence.

A conviction for a safety lane violation carries:

  • 4 demerit points
  • Fines between $200 and $300, plus administrative and court fees
  • Higher insurance premiums
  • Long-term impact on your driving record
